TORONTO - The province's police watchdog has concluded that there are no grounds to lay charges against a Toronto police officer in a fatal shooting.

Police were called to a home on Feb. 3 after reports that a man in a hospital gown was involved in a stabbing incident.

Upon arrival, police learned Michael Eligon, 29, had escaped from Toronto East General Hospital and was armed with scissors.

The Special Investigations Unit says Eligon tried to steal a couple of cars and break into several homes.

Police say an officer opened fire when Eligon, still armed with scissors, advanced on officers and said words to the effect of "one of you is going to die."

Eligon died of his injuries and SIU director Ian Scott says the officer was justified in opening fire.
