A former brewery owner with a flair for self-promotion will find out Tuesday if he will be acquitted or convicted of sexual assault.
A judge heard evidence in the case Monday and will render his verdict on Tuesday morning in the case of Frank D'Angelo.
D'Angelo, 49, told Justice John Hamilton that while having the one-night-stand with the daughter of a family friend one afternoon almost two years ago was a mistake, he didn't sexually assault her.
The woman, now 22, testified that she went with D'Angelo to his hotel room at a Holiday Inn near Yorkdale Mall on the pretext that D'Angelo had to retrieve something.
However, they never discussed the possibility of a job as event co-ordinator of the Steelback Grand Prix.
Instead, she alleged he grabbed her arm, stripped her naked, pulled her onto the bed and forced her into sex.
D'Angelo claimed the complainant flirted with him over lunch, kissed him in the hotel room and initiated consensual sex.
During cross-examination, the Crown noted that D'Angelo thought of himself as a pretty attractive guy, D'Angelo agreed.
"I'm going to suggest that you had a plan from the get-go, and that nothing was going to stop you -- not even when she said, 'No, stop, please,'" said prosecutor Mary Misener.
"No, not at all," D'Angelo replied.
In questioning the complainant, defence lawyer Gary Clewley wanted to know why she didn't flee the hotel room when D'Angelo was showering afterward.
The two left the hotel together and kissed in the parking lot, but the complainant said the kiss was forced.
Clewley argued the defendant was looking for a rich boyfriend, had sex with his client and then regretted it, which led to a complaint being made a day later.
Misener argued the complainant's story was credible.
D'Angelo came to minor fame as the front man for his commercials, including one for the Cheetah energy drink that had disgraced Olympian Ben Johnson declare: "I Cheetah all the time!"
However, D'Angelo's business empire collapsed, with control of the brewery going to former business partner Barry Sherman. John Sherman, Barry's son, now runs that company.
D'Angelo is trying to revitalize his D'Angelo Brands company, which includes the Cheetah energy drink.
