Voters in one of Toronto's northernmost municipal ridings will make another trip to the polls, after a Superior Court Justice said there were irregularities with the voters' list and the election results should be invalidated.

Incumbent Maria Augimeri held onto her seat in Ward 9 (York Centre) by beating runner-up Gus Cusimano by just 89 votes in the Oct. 25, 2010, municipal vote.

Cusimano launched a lawsuit claiming irregularities in the voting process led to skewed results.

Justice Alexandra Hoy concluded on Thursday that the irregularities were significant enough to warrant a fresh vote. A similar decision was reached for a Toronto District School Board vote involving trustee Stephnie Payne.

In a statement released Thursday, a representative for Augimeri said they felt the decision went too far.

"All elections have simple imperfections which equally affect all candidates," said executive assistant Robert Andreacchi. "I think it goes too far to invalidate an election result when the playing field was even. We expect the City to appeal the ruling. It is business as usual in our office."

A city spokesperson said they were reviewing the decision and considering an appeal.
