Anthony Bennett is back in jail after stealing plants from a Kensington Market shop, the same crime that led to his controversial arrest last year.

Bennett was taken into custody Friday, just days after he testified in the trial of shopkeeper David Chen, who allegedly tied him up in the back of a van last year for shoplifting flowers, CTV Toronto reports.

Chen and two co-workers face charges of assault and confinement for making what they call a citizen's arrest. The trial began last week.

In his testimony, Bennett admitted to stealing the flowers and returning to the store an hour later with the intention of swiping some more.

Under the law, a person can only perform a citizen's arrest on someone caught committing a crime.

Friday's arrest stems from a string of thefts between May and July. During that period, Bennett allegedly stole plants on several occasions from the Jungle Fruit Mart, a stall less than a kilometre from Chen's store.

Police said they only recently compiled the various complaints against Bennett, hence the delay in laying charges.

Bennett is scheduled to appear in court on Wednesday.
