TORONTO -- Police say no criminal charges will be laid in the drowning death of a three-year-old boy who was pulled from a swimming pool in north Toronto over the weekend.

The incident happened at a barbecue in a condo (near Don Mills Road and Lawrence Avenue East) on Saturday afternoon, where about 14 people were attending.

Police say several children were in the pool, with the mother of the victim on the patio.

When the mother went to the bathroom, her three-year-old son got into the pool without a flotation device.

Police say the boy had been under water for about three minutes before he was pulled out.

Officers performed CPR when they arrived, but the boy was later pronounced dead in hospital.
