The man who was found guilty of manslaughter in the death of a York Regional Police officer five years ago attempted to get his jail sentence reduced on Wednesday.
In August 2007, Nadeem Jiwa was caught stealing airbags from cars. When undercover cop Robert Plunkett tried to arrest Jiwa, he jumped into a car and reversed the engine, trapping Plunkett between a tree and the car.
Plunkett died of his injuries.
Wednesday, Jiwa appeared in the Court of Appeal for Ontario.
His lawyer, Clayton Ruby, argued that Jiwa's12-year sentence should be reduced to six years.
"He's a young man and he's going to get out. The question is, when he gets out, is he going to have a chance to live a normal life?" Ruby said outside of court.
If he does get the reduced sentence, Jiwa could be released from prison immediately.
Family members, including Plunkett's widow and his daughter, were in court to hear Jiwa's case.
"It's just been a really long journey, and this was a chapter we weren't expecting," said Plunkett's widow, Sonja Plunkett.
"I think we've dealt with it really well and we're just going to continue to move on," she said.
Fellow officers condemned the appeal attempt, saying that it is opening old wounds and forcing both officers and the family to relive Plunkett's tragic death.
"It's totally inappropriate, under the circumstances," said York Region Police Association president John Miskiw. "It just rejuvenates all those feelings that everybody went through."
The court has delayed its decision on the case, meaning the decision could be released in days, or months.
