A woman who was shot during the Boxing Day shooting spree took the stand Monday and testified she was on her way to a movie when suddenly, she couldn't move her legs.
Ellen Yu testified she was shot in the thigh and in her ankle by a spray of bullets being exchanged outside the Foot Locker store on Yonge Street on Dec. 26, 2005.
The shooting spree killed 15-year-old Jane Creba, an innocent bystander who was shopping with her sister. Several other bystanders were also wounded in the shootout.
A 20-year-old man is on trial, facing a second-degree murder charge plus several counts of attempted murder. He can only be identified as J.S.R. because he was a teen at the time the shooting took place.
Yu said Monday that she and a friend were looking for a cinema and were walking towards the Eaton Centre when she saw a group of youth running. She testified through a Cantonese interpreter that she saw what appeared to be small fireworks exploding on the ground.
She said she tried to run but her wounded legs wouldn't move.
The woman also testified that she never saw the gun or the shooters. She is expected to be called back to the witness stand on Tuesday.
J.S.R. is the first of nine people to go to trial in the case. Seven of those awaiting trial are adults and one is a young offender.
J.S.R. has been linked to a gun allegedly used at the crime scene. But he is not accused of firing the shot that killed Creba.
However, recent advances in Canadian criminal law mean that someone involved in a gunfight can be charged with murder if another person returns fire that kills a bystander.
