The Special Investigations Unit is taking over a case after a 39-year-old cyclist was struck by a police car in Scarborough’s Kennedy Park neighbourhood.

It happened near Kennedy and Merrian roads just before midnight on Monday.

The cyclist was riding westbound on Merrian Road while a Toronto police cruiser was driving north on Kennedy Road.

The two roads meet at a light-controlled intersection, which is where the cyclist and cruiser collided. It is unclear who had the right of way.

The cyclist was taken to Sunnybrook Hospital with broken bones, but is expected to recover.

There has been no information released about the police officer who was behind the wheel – other than the fact that the person was driving a 41 Division sergeant’s vehicle that ended up just north of the intersection.

Investigators will review the cruiser’s dash camera, which become activated when the lights and sirens are turned on.

Officers can also manually activate the camera, which is also set to turn on if the vehicle is involved in a collision that causes damage.

It is unclear whether the lights and sirens were activated in this case, but it is likely they were turned on by the collision, at the very least, if not by the officer.

If the dash camera was on, it could have cached up to 30 seconds of footage up until the collision.

The SIU has designated one subject officer and two witness officers in this case. They are asking any civilian witnesses to contact them.
