An Ontario coroner announced that an inquest will be held into the death of a man who was shot during an altercation with Toronto police.

Frank Anthony Berry, 48, was shot on Feb. 20, 2012 on Campbell Avenue, near Dundas Street West and Dupont Street.

He died in a nearby hospital shortly after the incident.

The Special Investigations Unit, Ontario's police watchdog, conducted a two-month investigation into the shooting before clearing the police officer who shot Berry.

The officer who shot Berry was conducting surveillance on an unrelated investigation when he saw Berry being chased by two residents, the SIU said.

The witnesses had seen a man breaking a window of a car nearby. As part of the pursuit, the SIU said Berry made "jabbing" motions with what the officer thought was a knife. He was twice asked to drop the weapon before being shot in the torso.

After he was shot, the officer found a pair of scissors.

The inquest into Berry's death will start Nov. 24, and is expected to last about a month. The jury will hear from approximately 20 witnesses, and will then make recommendations aimed at preventing similar deaths.
